These Terms and Conditions ("Terms") govern your use of the MyTreeHood sustainable agricultural program (the “Program”) offered by Treehood España S.L.U., a Limited Liability Company registered under the laws of Spain (Company Number B56242712) with registered address at 29 Pintor Mendoza, Valdepeñas, 13300, Spain ("MyTreehood", "we", “us” or "our"). These Terms set forth the terms and conditions of our relationship and for your use of the MyTreehood Website (the “Website”) in connection with the Program, including other related platforms, features, content, applications, mobile device applications, apps, offered by MyTreehood. Participants in the Program have the opportunity to participate in agricultural activities by adopting a tree. Before embarking on this journey, we encourage you to carefully review and understand these terms and conditions as they will govern our relationship and your participation in this Program. Your decision to participate signifies your acknowledgment and acceptance of the terms and conditions laid out herein. If you do not consent to these Terms, kindly refrain from participating in the Program. MyTreehood is not an investment product or service. The adoption of trees and harvest participation is not an investment or financial product. Proceeds from the harvest are based solely on agricultural production and are not guaranteed. MyTreehood provides participants with the opportunity to engage in an environmentally conscious agricultural initiative through the symbolic adoption of a tree. Participation in the Program entails supporting the cultivation and ongoing care of a designated tree, which is managed by MyTreehood and its affiliated agricultural partners as part of a sustainable farming operation. Upon adoption, MyTreehood undertakes the responsibility of maintaining and nurturing the adopted tree in accordance with sustainable agricultural practices. Participants will have access to periodic updates concerning the development, health, and progress of the adopted tree, which will be made available via the participant’s account on the Website. As the adopted tree reaches maturity and enters a productive phase, participants may, at MyTreehood’s discretion and subject to agricultural yield and prevailing environmental and market conditions, become eligible to receive a portion of the value derived from the tree’s harvest. Any such benefits are incidental to participation and are not guaranteed. The Program further includes access to educational content, regular progress reporting, and engagement in a broader ecological and community-based initiative focused on promoting sustainable land use, biodiversity, and responsible farming. The Website serves two principal functions: (i) to provide general information regarding MyTreehood’s sustainable agricultural projects and related environmental initiatives; and (ii) to facilitate participation in the Program by individuals who wish to support such initiatives. All content available on the Website is provided solely for informational purposes. Nothing contained on the Website or in any communication from MyTreehood is neither authorized, registered, nor regulated by the Financial Conduct Authority (FCA), the Spanish National Securities Market Commission (CNMV), or any other financial regulatory body. The Program does not involve the offering of financial products. Your participation represents an ecological and community contribution and does not confer ownership rights over trees, land, orchards, or products, nor does it give rise to any legal right to profits, income, or financial return.

During the registration process, you will be asked to provide accurate and current information. We may collect the following information: user's name, date of birth, email ID, and desired password. This information is necessary to create and manage user accounts. When creating an account, you must provide accurate, complete, and up-to-date information. It is crucial that you maintain the accuracy of your account information and promptly update it as necessary. MyTreehood reserves the right to suspend or terminate accounts with inaccurate or incomplete information.
  2. We require users to be at least 18 years old to create an account and participate in the Program. This ensures that you are capable of entering into a legally binding agreement with us. By accessing or using the Website and participating in the Program, you represent and warrant that you meet these eligibility requirements. You are responsible for maintaining the security and confidentiality of your account credentials, including your username and password. It is imperative that you do not share your login information with anyone else. MyTreehood will consider any actions taken through your account as authorized by you. Should you suspect any unauthorized access to your account, you must promptly notify MyTreehood.

MyTreehood will not be liable for any losses or damages incurred as a result of unauthorized access to your account or failure to protect your login information. It is recommended that you create a strong and unique password for your user account, incorporating a combination of letters, numbers, and symbols. Regularly updating your password is also advisable. MyTreehood will never request your password via email or any other unsolicited communication.
  4. Where the Two-Factor Authentication (2FA) feature is enabled, we strongly encourage the use of Two-Factor Authentication (2FA) for added security. Be cautious about emails or messages requesting your account information. MyTreehood will only communicate with you through official channels, and we will never ask you to disclose sensitive information via email. You are advised to always log out of your account when you finish your session, especially when using a shared or public computer. Failure to do so may compromise the security of your account. In the event you forget your password or encounter difficulties accessing your account, MyTreehood will provide mechanisms for account recovery. These processes are designed to confirm your identity and protect your account's security. If you choose to integrate your MyTreehood account with any third-party application, exercise caution and review their privacy and security policies. MyTreehood is not responsible for the security practices of third-party providers.
  5. Suspicious Activity: Should you observe any suspicious or unauthorized activity on your account, report it to MyTreehood immediately. We take security breaches seriously and will investigate and address any concerns promptly.

We reserve the right to terminate or suspend your account at any time without notice if we believe you have violated these Terms and Conditions.

Below, we outline what is expected from you as a participant and the services we provide in return.
    1. Tree Selection: Within the Website, you have the liberty to select a tree of your choice from the listed orchards. Our catalog includes trees of various kinds, prices and ages, with the minimum age requirement set at one (1) year old. You have the flexibility to adopt multiple trees either concurrently or at different times throughout your journey with MyTreehood. Note that if you make the decision to adopt a tree, we do not assign a specific tree for your adoption. Instead, your adoption extends to any tree within our orchard that matches the same type, age, and kind that you have selected.
    2. Term: MyTreehood offers a range of adoption durations, spanning from 2 to 30 years. This flexible timeframe allows you to choose a duration that aligns with your personal goals and involvement in the Program. The duration options provided are subject to change at our discretion. The Program runs for a minimum of two (2) years, with an option to renew, subject to relevant factors, market conditions, and availability. Please note that the renewal is not guaranteed, and the availability of the Program may depend on various factors. We will provide you with detailed information and terms regarding the renewal option at least thirty (30) days prior to the expiration of your then-current term
    3. User Dashboard: Upon adopting a tree, you will gain access to a dashboard on our Website. This dashboard enables you to monitor your tree's progress regularly by receiving updates. Forecasts and updates regarding your tree's growth and performance will be provided from time to time.
    4. Certificate of Adoption: Upon your purchase and adopting a tree with MyTreehood, we are pleased to provide you with a Certificate of Adoption. For each tree you adopt, a unique certificate will be issued to you.
  • 4.2. Incentives:
    At MyTreehood, we offer you the opportunity to benefit from your tree’s harvest, giving you flexibility in how you receive your share. As your adopted tree matures and starts bearing fruits, you have the prerogative to determine how you wish to receive your harvest. You may opt into one of the following ways:
    1. Option 1. You may choose to receive a portion of the physical harvest of fruits from your adopted tree. Please note that the process will only be initiated once all details are provided and shipping charges are agreed. Due to shipping regulations and varying costs associated with shipment, we may not be able to deliver to all locations. We do not guarantee shipment to all destinations. Any potential returns or proceeds from harvests are not guaranteed and depend entirely on factors such as weather conditions, seasonal fluctuations, and orchard performance. These returns are based on agricultural production and external market conditions.
    2. Option 2. You may choose to convert your share of the harvest to cash. This conversion will be based on the net proceeds from the sale of the harvest from your adopted tree. If you opt for this option, please note that the estimated cash value is calculated after deducting all necessary costs, including but not limited to orchard maintenance, logistics, labor, tools, and other related expenses including a 30% management fee. Payments will be processed within thirty (30) days from the date of the harvest sale. The amount you receive is subject to market conditions, including the actual sale price of the fruits and the performance of the orchard. This option is to be finalized or confirmed at the time of the harvest. Returns are not guaranteed and will depend on factors such as seasonal variations and orchard productivity. Proceeds from the harvest are based on the orchard’s performance and may vary due to natural factors, such as seasonal conditions and market fluctuations. There are inherent risks involved in agricultural activites, and we advise you to be aware that harvest is not guaranteed. MyTreehood does not offer financial products or services, and all decisions regarding harvest returns are based on agricultural production, which may fluctuate.
  • 4.3. Anti-Money Laundering:
    All payments and transactions related to the Program may be subject to due diligence checks as part of MyTreehood's Anti-Money Laundering (AML) and Know Your Customer (KYC) procedures. This may include identity verification and validation of the source of funds. MyTreehood reserves the right to refuse participation in the Program, or to delay or withhold payments related to the harvest, if concerns arise regarding compliance with Law 10/2010 of April 28 on the Prevention of Money Laundering and the Financing of Terrorism, on the prevention of money laundering and terrorist financing.

    MyTreehood is obligated to report any suspicious activity related to money laundering or terrorist financing to the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offenses (Sepblac).

You may opt to gift adoption of a selected tree or any of our other offerings to a third party ("Gift Recipient"). To do so, you must provide accurate and complete information about the Gift Recipient as requested during the gifting process. Once the tree is gifted and the onboarding process is complete, the account will be updated to reflect the name and other details of the Gift Recipient, as provided by you during the gifting process. You remain the primary party responsible for the participation in the Program including but not limited to compliance with these Terms and any associated liabilities, unless and until the Gift Recipient enters into a direct contract with us. It is your responsibility to notify the Gift Recipient of these Terms and they may be required to accept the MyTreehood Terms and Conditions to fully access or manage the user account. Failure to do so may limit their ability to participate in the Program. MyTreehood is not responsible for errors arising from inaccurate information provided by you about the Gift Recipient. We accept no liability for disputes between you and the Gift Recipient regarding the Program, and we are not responsible for any misuse, transfer, or failure by the Gift Recipient to engage with the Program. By providing Gift Recipient information, you confirm that you have obtained the necessary consent to share their details with us. Such information will be processed in line with our Privacy Policy. Once a gift is made to a third party, it is non-reversible and cannot be reassigned to the sender or a third party unless otherwise agreed by MyTreehood.

In the event that import control regulations specific to your country have been relaxed, you will have the opportunity to opt for receiving the harvests produced by your tree.

MyTreehood values your commitment to the Program and aims to provide a seamless experience throughout your journey with us. However, we understand that circumstances may change. To address such situations, we have established a clear cancellation policy. In accordance with consumer protection laws, Clients may request a refund or cancellation of their tree adoption within 14 days of the initial purchase. If you wish to terminate your participation in the Program within the initial 14 days after commencement, we will terminate your user account and you will be refunded any fees you paid to us in connection with the adoption of the tree after deducting all associated banking charges and exchange costs, where applicable. Should you decide to cancel your contract after the initial 14 days, you may not be eligible for a full refund. We will assess each request on a case by case basis. Eligible refunds will be processed within 30 business days but it may take longer as processing times may vary depending on several factors.
