MYTREEHOOD TERMS AND CONDITIONS

These Terms form the foundation of our agreement with you, (the “Client”, “Member”, “Customer”, or “User”) and establish the framework for your engagement with MyTreehood. By creating an account with the Website or otherwise engaging with the Program, you signify your understanding and acceptance of these Terms. They outline the rights and responsibilities of both parties, set the guidelines for your participation in the Program, and underscore our commitment to transparency and sustainability.

MyTreehood provides participants with the opportunity to engage in an environmentally conscious agricultural initiative through the symbolic adoption of a tree. Participation in the Program entails supporting the cultivation and ongoing care of a designated tree, which is managed by MyTreehood and its affiliated agricultural partners as part of a sustainable farming operation. Upon adoption, MyTreehood undertakes the responsibility of maintaining and nurturing the adopted tree in accordance with sustainable agricultural practices. Participants will have access to periodic updates concerning the development, health, and progress of the adopted tree, which will be made available via the participant’s account on the Website. As the adopted tree reaches maturity and enters a productive phase, participants may, at MyTreehood’s discretion and subject to agricultural yield and prevailing environmental and market conditions, become eligible to receive a portion of the value derived from the tree’s harvest. Any such benefits are incidental to participation and are not guaranteed. The Program further includes access to educational content, regular progress reporting, and engagement in a broader ecological and community-based initiative focused on promoting sustainable land use, biodiversity, and responsible farming. The Website serves two principal functions: (i) to provide general information regarding MyTreehood’s sustainable agricultural projects and related environmental initiatives; and (ii) to facilitate participation in the Program by individuals who wish to support such initiatives. All content available on the Website is provided solely for informational purposes. Nothing contained on the Website or in any communication from MyTreehood is neither authorized, registered, nor regulated by the Financial Conduct Authority (FCA), the Spanish National Securities Market Commission (CNMV), or any other financial regulatory body. The Program does not involve the offering of financial products. Your participation represents an ecological and community contribution and does not confer ownership rights over trees, land, orchards, or products, nor does it give rise to any legal right to profits, income, or financial return.

1. To participate in the Program, you will be required to furnish us with specific registration and account details. MyTreehood will utilize this information to create your user account. During the registration process, you will be asked to provide accurate and current information. We may collect the following information: user's name, date of birth, email ID, and desired password. This information is necessary to create and manage user accounts. When creating an account, you must provide accurate, complete, and up-to-date information. It is crucial that you maintain the accuracy of your account information and promptly update it as necessary. MyTreehood reserves the right to suspend or terminate accounts with inaccurate or incomplete information.
2. We require users to be at least 18 years old to create an account and participate in the Program. This ensures that you are capable of entering into a legally binding agreement with us. By accessing or using the Website and participating in the Program, you represent and warrant that you meet these eligibility requirements. You are responsible for maintaining the security and confidentiality of your account credentials, including your username and password. It is imperative that you do not share your login information with anyone else. MyTreehood will consider any actions taken through your account as authorized by you. Should you suspect any unauthorized access to your account, you must promptly notify MyTreehood.
3. You acknowledge and agree that you are solely responsible for any activities conducted through your account. MyTreehood will not be liable for any losses or damages incurred as a result of unauthorized access to your account or failure to protect your login information. It is recommended that you create a strong and unique password for your user account, incorporating a combination of letters, numbers, and symbols. Regularly updating your password is also advisable. MyTreehood will never request your password via email or any other unsolicited communication.
4. Where the Two-Factor Authentication (2FA) feature is enabled, we strongly encourage the use of Two-Factor Authentication (2FA) for added security. Be cautious about emails or messages requesting your account information. MyTreehood will only communicate with you through official channels, and we will never ask you to disclose sensitive information via email. You are advised to always log out of your account when you finish your session, especially when using a shared or public computer. Failure to do so may compromise the security of your account. In the event you forget your password or encounter difficulties accessing your account, MyTreehood will provide mechanisms for account recovery. These processes are designed to confirm your identity and protect your account's security. If you choose to integrate your MyTreehood account with any third-party application, exercise caution and review their privacy and security policies. MyTreehood is not responsible for the security practices of third-party providers.
5. Suspicious Activity: Should you observe any suspicious or unauthorized activity on your account, report it to MyTreehood immediately. We take security breaches seriously and will investigate and address any concerns promptly.

By registering an account with MyTreehood, you agree to adhere to these security measures and acknowledge your responsibility for the security of your account. We reserve the right to terminate or suspend your account at any time without notice if we believe you have violated these Terms and Conditions.

• 4.1. The MyTreehood Program.
  At MyTreehood, we offer a unique and meaningful opportunity that revolves around the adoption and care of trees, allowing you to contribute to sustainable environmental practices while enjoying the benefits of being part of a greener future. Below, we outline what is expected from you as a participant and the services we provide in return.
  1. Tree Selection: Within the Website, you have the liberty to select a tree of your choice from the listed orchards. Our catalog includes trees of various kinds, prices and ages, with the minimum age requirement set at one (1) year old. You have the flexibility to adopt multiple trees either concurrently or at different times throughout your journey with MyTreehood. Note that if you make the decision to adopt a tree, we do not assign a specific tree for your adoption. Instead, your adoption extends to any tree within our orchard that matches the same type, age, and kind that you have selected.
  2. Term: MyTreehood offers a range of adoption durations, spanning from 2 to 30 years. This flexible timeframe allows you to choose a duration that aligns with your personal goals and involvement in the Program. The duration options provided are subject to change at our discretion. The Program runs for a minimum of two (2) years, with an option to renew, subject to relevant factors, market conditions, and availability. Please note that the renewal is not guaranteed, and the availability of the Program may depend on various factors. We will provide you with detailed information and terms regarding the renewal option at least thirty (30) days prior to the expiration of your then-current term
  3. User Dashboard: Upon adopting a tree, you will gain access to a dashboard on our Website. This dashboard enables you to monitor your tree's progress regularly by receiving updates. Forecasts and updates regarding your tree's growth and performance will be provided from time to time.
  4. Certificate of Adoption: Upon your purchase and adopting a tree with MyTreehood, we are pleased to provide you with a Certificate of Adoption. For each tree you adopt, a unique certificate will be issued to you.
• 4.2. Incentives:
  At MyTreehood, we offer you the opportunity to benefit from your tree’s harvest, giving you flexibility in how you receive your share. As your adopted tree matures and starts bearing fruits, you have the prerogative to determine how you wish to receive your harvest. You may opt into one of the following ways:
  1. Option 1. You may choose to receive a portion of the physical harvest of fruits from your adopted tree. Please note that the process will only be initiated once all details are provided and shipping charges are agreed. Due to shipping regulations and varying costs associated with shipment, we may not be able to deliver to all locations. We do not guarantee shipment to all destinations. Any potential returns or proceeds from harvests are not guaranteed and depend entirely on factors such as weather conditions, seasonal fluctuations, and orchard performance. These returns are based on agricultural production and external market conditions.
  2. Option 2. You may choose to convert your share of the harvest to cash. This conversion will be based on the net proceeds from the sale of the harvest from your adopted tree. If you opt for this option, please note that the estimated cash value is calculated after deducting all necessary costs, including but not limited to orchard maintenance, logistics, labor, tools, and other related expenses including a 30% management fee. Payments will be processed within thirty (30) days from the date of the harvest sale. The amount you receive is subject to market conditions, including the actual sale price of the fruits and the performance of the orchard. This option is to be finalized or confirmed at the time of the harvest. Returns are not guaranteed and will depend on factors such as seasonal variations and orchard productivity. Proceeds from the harvest are based on the orchard’s performance and may vary due to natural factors, such as seasonal conditions and market fluctuations. There are inherent risks involved in agricultural activites, and we advise you to be aware that harvest is not guaranteed. MyTreehood does not offer financial products or services, and all decisions regarding harvest returns are based on agricultural production, which may fluctuate.
• 4.3. Anti-Money Laundering:
  All payments and transactions related to the Program may be subject to due diligence checks as part of MyTreehood's Anti-Money Laundering (AML) and Know Your Customer (KYC) procedures. This may include identity verification and validation of the source of funds. MyTreehood reserves the right to refuse participation in the Program, or to delay or withhold payments related to the harvest, if concerns arise regarding compliance with Law 10/2010 of April 28 on the Prevention of Money Laundering and the Financing of Terrorism, on the prevention of money laundering and terrorist financing.
  
  MyTreehood is obligated to report any suspicious activity related to money laundering or terrorist financing to the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offenses (Sepblac).

You may opt to gift adoption of a selected tree or any of our other offerings to a third party ("Gift Recipient"). To do so, you must provide accurate and complete information about the Gift Recipient as requested during the gifting process. Once the tree is gifted and the onboarding process is complete, the account will be updated to reflect the name and other details of the Gift Recipient, as provided by you during the gifting process. You remain the primary party responsible for the participation in the Program including but not limited to compliance with these Terms and any associated liabilities, unless and until the Gift Recipient enters into a direct contract with us. It is your responsibility to notify the Gift Recipient of these Terms and they may be required to accept the MyTreehood Terms and Conditions to fully access or manage the user account. Failure to do so may limit their ability to participate in the Program. MyTreehood is not responsible for errors arising from inaccurate information provided by you about the Gift Recipient. We accept no liability for disputes between you and the Gift Recipient regarding the Program, and we are not responsible for any misuse, transfer, or failure by the Gift Recipient to engage with the Program. By providing Gift Recipient information, you confirm that you have obtained the necessary consent to share their details with us. Such information will be processed in line with our Privacy Policy. Once a gift is made to a third party, it is non-reversible and cannot be reassigned to the sender or a third party unless otherwise agreed by MyTreehood.

Some regions may enforce strict import control regulations that could impact your ability to receive the harvested products directly. In such cases, we may be compelled to provide you with alternative options instead of physical harvests. This ensures compliance with local import regulations and guarantees the seamless flow of your returns. MyTreehood diligently monitors import control regulations across various jurisdictions. We regularly assess these regulations to identify any changes or relaxations that may occur over time. In the event that import control regulations specific to your country have been relaxed, you will have the opportunity to opt for receiving the harvests produced by your tree.

At MyTreehood, We offer performance forecasts and projections of the tree you have adopted. These forecasts are available on your personalized dashboard, providing you with a glimpse into the anticipated performance of your tree. These forecasts are derived from our analysis, insights from our team, and available market information. We recognize that the agricultural landscape of trees within our orchard is dynamic and subject to various environmental factors. Consequently, we endeavor to update the forecasts periodically to ensure they reflect the most current information and performance trends. Note however that the performance of trees can be influenced by a multitude of ever-changing variables. Therefore, the forecasts may not always be entirely accurate or complete. We encourage you to utilize these forecasts as a resource while keeping in mind that they serve as an estimate rather than an absolute prediction.

MyTreehood values your commitment to the Program and aims to provide a seamless experience throughout your journey with us. However, we understand that circumstances may change. To address such situations, we have established a clear cancellation policy. In accordance with consumer protection laws, Clients may request a refund or cancellation of their tree adoption within 14 days of the initial purchase. If you wish to terminate your participation in the Program within the initial 14 days after commencement, we will terminate your user account and you will be refunded any fees you paid to us in connection with the adoption of the tree after deducting all associated banking charges and exchange costs, where applicable. Should you decide to cancel your contract after the initial 14 days, you may not be eligible for a full refund. We will assess each request on a case by case basis. Eligible refunds will be processed within 30 business days but it may take longer as processing times may vary depending on several factors.

Occasionally, we provide our users with educational resources that cover a wide array of topics, including details about the Program, as well as general insights into the agricultural and sustainable farming landscape. These resources, often presented in the form of white papers, are intended to serve as informative references. Note that the information contained within our white papers is crafted based on the author's knowledge and research of the subject matter. These documents are designed to offer educational value and foster a deeper understanding of the fields they cover. If you choose to read through and use the information presented in our white papers, please be aware that our general disclaimers apply to you. We kindly urge you to thoroughly review these disclaimers as they provide critical information regarding the nature and limitations of the content contained within our educational resources. Our disclaimers address a range of topics, including the accuracy of the information, the potential for changes in the agricultural landscape, and the implications of utilizing the information for investment decisions. We may occasionally provide opportunities for you to visit the trees at any of our orchards. However, it's important to understand the guidelines associated with these visits. Any visit to our orchards are subject to prior advance notice to us. We kindly request that you inform us in advance of your intention to visit. This allows us to make the necessary arrangements and ensures that your visit is both safe and enjoyable. Please be aware that any visits to our orchards are at your own cost and risk. While we strive to provide a safe and welcoming environment, it's essential to acknowledge and assume responsibility for any costs or risks associated with your visit. In addition to visits, we may also plan annual events, which could include post-harvest events, among others. These events are designed to provide you with insights into the progress of your adopted trees and offer a chance to connect with the MyTreehood community. Details about these events, including their dates and locations, will be made available on the Website. We encourage you to regularly check the Website for event updates and information. To ensure that you stay informed about upcoming events, we may send notifications directly to you. These notifications will provide you with event details and instructions on how to participate.

Copyright Content is protected under applicable copyrights, trademarks, and proprietary rights. You may not copy, redistribute, use, or publish any part of the Website or the Program, except as expressly permitted by these Terms. Your usage of the Website and participation in the Program is limited to the extent outlined in these Terms.

Trademarks: MyTreehood's trademarks, including but not limited to "MyTreehood," "www.MyTreehood.com," "www.MyTreehood.es," and associated graphics, logos, and service names ("Trademark Content") are owned by MyTreehood or its affiliates. These trademarks are protected by applicable trademark laws.
3. Responsible Use: You agree not to use MyTreehood's trademarks in a manner that may cause confusion among customers or that disparages or discredits MyTreehood. Additionally, you may not use trademarks not owned by MyTreehood or its affiliates without proper authorization.
4. Limited License: MyTreehood grants you a limited, non-exclusive license to access and make personal use of the Website. However, this license does not include the right to download, modify, reproduce, resell, create derivative works, or engage in commercial use of the Website, or the Program, except as expressly permitted herein.
5. Conduct Policies: When using the Website, you agree to abide by MyTreehood's conduct policies, which include respecting intellectual property rights, refraining from reverse engineering, and refraining from interfering with the proper functioning of the Website.

To maintain a safe, respectful, and compliant environment within MyTreehood's community, certain activities and uses are strictly prohibited. By using our Website and participating in the Program, you agree not to engage in the following prohibited activities:

1. You will not modify, adapt, redistribute, reproduce, distribute, translate, create derivative works, publicly display, republish, repurpose, sell, trade, or exploit any part of the Website beyond what is expressly allowed by these Terms. You will not take any action that imposes or may impose an unreasonable or disproportionately large load on MyTreehood's infrastructure or the infrastructure of our third-party providers, as determined by MyTreehood in its sole discretion.
2. You will not decipher, decompile, disassemble, reverse engineer, or attempt to derive any source code or underlying ideas or algorithms of any part of the Website, except to the limited extent that applicable laws specifically prohibit such restrictions. Additionally, you agree not to interfere or attempt to interfere with the proper functioning of the Website or any activities conducted thereon.
3. You will not bypass any measures that MyTreehood or its third-party providers use to prevent or restrict access to the Website or other accounts, computer systems, or networks connected to them. You will also not use the Website to send spam, engage in automated email campaigns, or use any form of auto-responder, neither will you use data mining, robots, or similar data gathering and extraction tools to collect information from the Website.
4. You will not use the Website for commercial purposes, such as reselling or making commercial use of the Website or its contents. You will not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of MyTreehood or its affiliates without express written consent. You will also not use meta tags or any other "hidden text" utilizing MyTreehood's name or trademarks without such consent. You will not engage in the copying, reproduction, publication, rearrangement, redistribution, modification, revision, alteration, or reverse engineering of the Website.
5. You agree not to upload, post, transmit, share, store or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. You will not create hyperlinks to the MyTreehood home page without express written permission, especially if such hyperlinks include MyTreehood's logos or other proprietary graphics or trademarks.
6. You will not upload, post, transmit, share, store or otherwise make available any content (such as a picture on a profile page) other than those of a personal nature that: (i) are of you, (ii) are taken by you, or (iii) are original content created by you. You will not otherwise take any action in violation of our guidelines and policies or that infringes the intellectual property rights of a third party.
7. You will not threaten, intimidate, or harass other users or parties through the Website or members of the MyTreehood community. You also agree not to falsely represent your identity, impersonate a third party, or mislead third parties regarding your affiliation with any entity.

By using the Website and participating in the Program, you agree to abide by these terms and to conduct yourself in a responsible, respectful, and lawful manner. We reserve the right to terminate your account without liability if we suspect that you have breached any of the foregoing conditions.

When you decide to adopt a tree and participate in the Program, you will need to complete the adoption process on your user account on the Website. During this process, you will be guided through various steps, which may include selecting a tree, specifying your adoption duration, and providing payment information. As part of the purchase process, you will be required to review and accept these Terms and execute a customer agreement. Upon completing the onboarding process and accepting these Terms, you will receive a confirmation of your adoption, along with relevant details about your agreement with us. This confirmation will serve as evidence of your agreement to the terms and conditions. Your agreement with us continues throughout the duration of your selected term. You will have access to your unique dashboard, where you can monitor the progress of your adopted tree, view forecasts, and make choices regarding the harvest as outlined in these Terms. Note that your agreement with MyTreehood is a legally binding contract, and your continued participation in the Program implies your ongoing acceptance of these Terms. We recommend that you retain a copy of these Terms and any related documents for your records. If you have any questions or concerns about these Terms, your customer agreement or the onboarding process, please don't hesitate to contact us for clarification.

3. Trademarks: MyTreehood's trademarks, including but not limited to "MyTreehood," "www.MyTreehood.com," and associated graphics, logos, and service names ("Trademark Content") are owned by MyTreehood or its affiliates. These trademarks are protected by applicable trademark laws.
4. Responsible Use: You agree not to use MyTreehood's trademarks in a manner that may cause confusion among customers or that disparages or discredits MyTreehood. Additionally, you may not use trademarks not owned by MyTreehood or its affiliates without proper authorization.
5. Limited License: MyTreehood grants you a limited, non-exclusive license to access and make personal use of the Website and the Investment Management activity. However, this license does not include the right to download, modify, reproduce, resell, create derivative works, or engage in commercial use of the Website and the Investment Management activity, except as expressly permitted herein.
6. Conduct Policies: When using the Website and the Investment Management activity, you agree to abide by MyTreehood's conduct policies, which include respecting intellectual property rights, refraining from reverse engineering, and refraining from interfering with the proper functioning of the Platform, among other commitments.

THE PROGRAM IS AN INITIATIVE SOLELY INTENDED TO SUPPORT AND PROMOTE SUSTAINABLE, ENVIRONMENTALLY RESPONSIBLE FARMING. IT IS NOT, AND MUST NOT BE CONSTRUED AS, A FINANCIAL PRODUCT, INVESTMENT OPPORTUNITY, OR SOLICITATION FOR INVESTMENT. MYTREEHOOD DOES NOT OFFER FINANCIAL SERVICES, DOES NOT PROVIDE INVESTMENT ADVICE, AND IS NOT REGULATED OR AUTHORISED BY THE FINANCIAL CONDUCT AUTHORITY (FCA), THE SPANISH NATIONAL SECURITIES MARKET COMMISSION (CNMV), OR ANY OTHER FINANCIAL REGULATORY BODY. PARTICIPATION IN THE PROGRAM DOES NOT CONFER ANY OWNERSHIP OR PROPRIETARY RIGHTS IN ANY TREE, ORCHARD, LAND, OR PRODUCE. ANY BENEFITS OR RETURNS ARISING FROM THE HARVEST (IF APPLICABLE) ARE NOT GUARANTEED AND ARE ENTIRELY DEPENDENT ON ENVIRONMENTAL CONDITIONS, SEASONAL FACTORS, AND THE NATURAL PRODUCTIVITY OF THE ORCHARD. WHILE MYTREEHOOD EMPLOYS SUSTAINABLE FARMING PRACTICES TO ENCOURAGE HEALTHY YIELDS, WE DO NOT PROMISE, PREDICT, OR ENSURE ANY SPECIFIC OUTCOMES OR RETURNS FROM YOUR PARTICIPATION IN THE PROGRAM. BY ADOPTING A TREE, YOU ARE SUPPORTING A GREEN INITIATIVE THAT CONTRIBUTES TO SUSTAINABLE AGRICULTURE AND ENVIRONMENTAL WELLBEING. ANY HARVEST PARTICIPATION IS A BONUS AND NOT THE PURPOSE OR GUARANTEE OF THE PROGRAM. THE PROGRAM IS AN AGRICULTURAL SUPPORT INITIATIVE, NOT A FINANCIAL ARRANGEMENT. YOUR CONTRIBUTION IS NOT SUBJECT TO ANY FINANCIAL GAIN OR LOSS IN THE WAY THAT TRADITIONAL INVESTMENTS ARE. PARTICIPATION SHOULD BE MOTIVATED BY A DESIRE TO SUPPORT ECOLOGICAL FARMING PRACTICES AND SUSTAINABILITY, NOT BY EXPECTATIONS OF PROFIT. TO THE FULLEST EXTENT PERMITTED BY LAW, MYTREEHOOD DISCLAIMS ANY LIABILITY FOR LOSSES OR DAMAGES (DIRECT, INDIRECT, CONSEQUENTIAL, OR OTHERWISE) ARISING FROM RELIANCE ON ANY EXPECTATION OF FINANCIAL RETURN OR OWNERSHIP CONNECTED WITH THE PROGRAM.

By using the Orchard and Harvest Share Management activity offered by MyTreehood, you represent and warrant that: (i) you have the legal capacity and authority to enter into these Terms, and if applicable, to participate in any opportunities presented through the Website; (ii) you are 18 years of age or older; (iii) you will use the Website in compliance with all applicable laws and regulations; (iv) any information you provide to MyTreehood, including during the registration process, is accurate and complete; (v) you will not engage in any unauthorized or unlawful activities on the Website or in connection with the Program; (vi) you understand and acknowledge that MyTreehood does not provide financial, investment, or tax advice, and you are encouraged to seek professional advice before making any decisions, and you shall conduct your own due diligence and seek professional advice as necessary before making any financial decision; (vii) you understand and acknowledge that MyTreehood does not guarantee the performance or success of any tree; (viii) you will not misrepresent your identity, credentials, or affiliations when using the Website; (ix) you will not infringe upon the intellectual property rights of MyTreehood or any third parties while using the Website; (x) you will not use the Website for any unauthorized or illegal purposes; (xi) you will cooperate fully with MyTreehood in the event of any investigations or disputes related to your use of the Website; (xii) you will comply with MyTreehood's Privacy Policy and all applicable privacy laws and regulations; (xiii) you agree to comply with all anti-money laundering (AML) regulations, providing necessary documentation upon. Your use of the Website and participation in the Program is contingent upon these representations and warranties, and MyTreehood reserves the right to suspend or terminate your access to the Website and the Program if any of these representations or warranties are found to be untrue or violated.

Clients are responsible for ensuring compliance with all applicable laws, including tax obligations, in their respective jurisdictions. MyTreehood will not be liable for any legal or financial consequences arising from non-compliance.

To the fullest extent permitted by applicable law, MyTreehood Ltd, its directors, officers, employees, affiliates, agents, contractors, partners, and licensors (collectively, "MyTreehood") shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of anticipated savings, loss of goodwill, loss of data, or business interruption, arising out of or in connection with: (i) your participation in the Adopt a Tree Program (the “Program”); (ii) your reliance on any outcomes or expectations relating to harvest returns or benefits; (iii) any misunderstanding of the nature of the Program as an investment or financial product, or (iv) any environmental, agricultural, or seasonal factors that affect tree or orchard productivity.
2. The Program is provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. MyTreehood does not warrant or guarantee that: (i) any tree adopted will produce fruit or result in a successful harvest; (ii) any harvest will yield a specific quantity or quality of produce; (iii) the delivery of any associated benefits will occur within a particular timeframe or at all; (iv) environmental conditions, pests, disease, or other agricultural risks will not adversely impact the orchard. MyTreehood may use third-party service providers or partners to manage or facilitate aspects of the Program. MyTreehood shall not be held responsible or liable for any actions, omissions, negligence, or misrepresentations by third parties, or for any losses or damages resulting from reliance on third-party systems, services, or communications.
3. MyTreehood shall not be liable or deemed to be in breach of any agreement for any failure or delay in performing its obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to natural disasters, severe weather conditions, crop failure, drought, pestilence, government action, labor disputes, pandemics, supply chain disruptions, or any other events commonly classified as force majeure.
4. d.You acknowledge and agree that: (i) you are participating in the Program with a clear understanding that it is not a commercial investment; (ii) any expectations of return are entirely speculative and incidental; (iii) your involvement supports environmental and sustainable agriculture goals, not profit-making objectives, and (iv) it is your responsibility to seek independent advice if you are unclear about the nature or implications of participating in the Program.
5. Notwithstanding any provision to the contrary, and to the extent that liability cannot be excluded under applicable law, MyTreehood’s total cumulative liability to you for any claims, losses, damages, or causes of action (whether in contract, tort, or otherwise) shall be strictly limited to the total amount you paid to participate in the Program. Nothing in this Limitation of Liability section is intended to exclude or limit any statutory rights to which you may be entitled as a consumer under applicable law. If you are a consumer, you may have rights under consumer protection legislation that cannot be waived or disclaimed.

You agree to indemnify, defend, and hold harmless MyTreehood and its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Website and participating in the Program, your violation of these Terms, or your violation of any rights of any third party in relation to any of the services offered by us. This indemnification provision shall apply to any third-party claims as well as any claims between you and MyTreehood. MyTreehood reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with MyTreehood in asserting any available defenses.
